Chitungwiza Municipality Ordered to Comply with High Court Order

Efforts by Chitungwiza Municipality to continue using its dumping were in vain after Justice Charewa directed them to either open a new dumpsite at a more appropriate site with safe guards or to comply with the High Court order which ordered it to erect a fence and danger warning signs at this dumping site. This directive came after the Municipality filed an urgent chamber application to stay execution of the court order which was granted in favour of 2 families who lost a child and another one, severely burn due to chemical waste disposed at this site. 

Assisted by the Zimbabwe Human Rights NGO Forum, these families obtained a court order on the 4th of November 2020 which interdicted the Municipality to use this dumping site until it has been commissioned by EMA. On the 16th of November, Justice Charewa directed that the urgent chamber application filed by the Chitungwiza through their lawyers, Matsikidze Attorneys at Law, be removed from the urgent roll since the Municipality or the people of Chitungwiza will not suffer irreparable harm if that matter is not decided on urgent basis.
