The Zimbabwe Human Rights NGO Forum is representing the victim of the 1st of August 2018 violence, Andy Manyeruke. Manyeruke has sued President Mnangagwa and the Ministry of Justice, Legal and Parliamentary Affairs over Motlanthe Commission of Inquiry Report. Andy Manyeruke, who is disabled was shot by the soldiers on the 1st of August 2018 violence that erupted in Harare CBD. Through the court application that was filed in the Harare High Court on the 10th of November 2020, Andy Manyeruke, argued that although in terms of the Commissions of Inquiries Act [ Chapter 10:07], there is no obligation upon the President to adopt recommendations made by a commission, the government has accepted the recommendations and committed to adopt them.
He argued that the President’s remarks and those of the permanent secretary in the Ministry of Justice, Legal and Parliamentary Affairs created a legitimate expectation that he will be compensated for the injuries he sustained during the August 2018 violence. Andy is seeking to compel the President to comply with recommendation stated in Commission’s report for the payment of his compensation for all victims of the violence and dependents of the deceased.
