Case Alert: Court Orders Chitungwiza Municipality To Fence Off ‘Killer’ Dumpsite

The Forum successfully obtained a court order in favor of three Chitungwiza families who lost two children due to severe burns at Chitungwiza Dumpsite. Harare High Court Judge Dube on the 4th of November 2020 granted an order which declared that the Chitungwiza Municipality is operating its dumpsite illegally, in a manner which violates the residents’ right to a safe environment. This Municipality was also directed to fence off the dumpsite with wrought iron fence and erect visible warning signs indicating areas which pose danger to the public. It was further interdicted and prohibited from operating the dumpsite and permitting the dumping of waste until the site has been certified and commissioned for use in writing by the Environmental Management Agency (EMA).
